ONLINE STORE SALES TERMS

The owner of the Morna Õnne Talu online store (hereinafter referred to as the Online Store/shop) is OÜ Morna Õnne Talu (registry code 11136300), located in Morna village, Mulgi municipality, Viljandi County.

Validity of the sales contract, product and price information

These sales terms apply when purchasing goods from the Online Store. The prices of the products sold in the Online Store are marked next to the products. A delivery fee is added to the price of the goods. All prices of goods sold in the Online Store are in euros. The delivery fee for the goods depends on the buyer’s location and the method of delivery. The delivery fee will be displayed to the buyer when placing the order. Information about the goods is provided directly next to the goods in the Online Store. Alcohol is sold only to adult customers who confirm at the time of ordering that they are at least 18 years old. The customer’s age will be verified upon delivery of the alcohol. The courier has the right to request an identification document to verify the age upon delivery of alcohol. If the document is not presented, the courier has the right not to deliver the aforementioned products.

Order placement

To order goods, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled in and a suitable delivery method selected. The amount to be paid will then be displayed on the screen, which can be paid securely through the following payment methods:

– Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Bank
– Visa/Mastercard card payments

Note! When paying with a bank link, make sure to press the “Back to merchant” button on the bank’s page.

Payments are processed by Maksekeskus AS. Payments take place outside the Online Store in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The merchant has no access to the customer’s bank and credit card information. The contract comes into effect upon receipt of the payment amount into the Online Store’s bank account.

Morna Õnne Talu OÜ is the data controller of personal data and will transmit the personal data necessary for processing payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to stock depletion or for any other reason, the buyer will be informed as soon as possible, and the paid amount (including delivery costs) will be refunded without delay, but not later than within 14 days from the sending of the notice.

Delivery

Goods are shipped within Estonia. We use Itella-Smartpost parcel machines for receiving goods. The shipping costs will be paid by the buyer, and the corresponding price information is displayed next to the shipping method. Domestic shipments generally reach the buyer’s specified destination within 2-3 working days from the conclusion of the sales contract.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

Note! Depending on the products, the buyer may not have the right of withdrawal; the relevant products and services must be listed in such cases, and they must meet the conditions listed in the Law of Obligations Act § 53(4).

To use the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, as allowed for testing the goods in a physical store.

If the goods have been used for purposes other than what is necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refund amount according to the decrease in the value of the goods.

To return the goods, a withdrawal request must be submitted, the form of which can be found here, and sent to the email address georg45@gmail.com no later than 14 days from the receipt of the goods.

The buyer bears the costs of returning the goods, except when the reason for the return is that the product being returned does not correspond to what was ordered (e.g., incorrect or defective product).

The buyer must return the goods within 14 days following the submission of the request or provide proof that they have handed the goods over to a carrier within the aforementioned period.

The Online Store will refund all amounts received from the buyer under the contract upon receipt of the returned goods without delay, but no later than within 14 days from the receipt of the withdrawal request.

The Online Store may refuse to make refunds until it has received the item that is the subject of the contract back or until the buyer has provided proof that they have sent the item back, depending on which occurs first.

If the buyer has expressly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store does not have to refund the costs that exceed those related to the standard delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store has been mistakenly indicated as significantly below the market price of the goods.

Right to make a complaint

The Online Store is responsible to the buyer for any non-conformity or defect of the goods sold that existed at the time of transfer of the item and which appears within two years from the transfer of the goods to the buyer. Within the first six months from the transfer of the item to the buyer, it is presumed that the defect existed at the time of transfer. It is the Online Store’s obligation to refute this presumption.

The buyer has the right to turn to the Online Store within two months of the defect appearing by sending an email to georg45@gmail.com or by calling +372 5660 4287.

The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all amounts paid under the sales contract to the buyer.

The Online Store will respond to the consumer’s complaint in writing or in a form that allows written reproduction within 15 days.

Direct marketing and personal data processing

The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store will transmit personal data to the companies providing transport services for the purpose of delivering the goods.

The Online Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed a desire to do so by entering their email address on the website and indicated their wish to receive direct marketing communications.

The buyer can unsubscribe from the email offers and newsletters at any time by notifying us via email or following the instructions provided in the emails containing the offers.

Dispute resolution

If the buyer has complaints about the Online Store, they should be sent to the email address georg45@gmail.com or by calling +372 5660 4287.

If the buyer and the Online Store cannot resolve the dispute through agreement, the buyer has the option to turn to the Consumer Disputes Committee. The conditions for the procedure can be reviewed and applications submitted here. The Consumer Disputes Committee has the competence to resolve disputes arising from the contract concluded between the buyer and the Online Store. The examination of the buyer’s complaint in the committee is free of charge.

The buyer may turn to the European Union consumer dispute resolution platform.
